At a hearing tomorrow at 2:00 p.m., Marty Tankleff's lawyers will ask Suffolk County Judge James C. Hudson to recuse himself from the Tankleff case. Judge Hudson presides over the grand jury being used by Attorney General and Special Prosecutor Andrew Cuomo in his investigation of the Tankleff case.
Earlier this week, Judge Hudson informed Marty's attorneys that he had been the Suffolk County District Attorney’s Deputy Bureau Chief at the time of the original Tankleff investigation and trial in the late 80s. This revelation creates a kind of Conflict of Interest Hall of Mirrors, since a defense motion currently before Judge Hudson questions the fairness of the Attorney General’s use of a Suffolk County grand jury, since the conflicted Suffolk County DA and other law enforcement agents would be appearing before the very same grand jury.
The hearing will take place at the Arthur M. Cromarty Court Complex, 210 Center Drive, Riverhead, NY 11901.
